Abstract

People with disabilities are a population group that has normally been stigmatized, rejected by society and subject to multiple discriminations. Within these stigmas, in particular, one is addressed; in the sense that the decisions made by this group of people are erroneous, therefore, their will is nullified so that a third party decides for them. The above becomes relevant since this invalidity of will is based on the legal institution of interdiction – regulated by national law. Thus, through the social approach and human rights model, the mishandling of terms regarding the legal capacity and mental capacity of people with disabilities is questioned, giving way to the question: What is an incorrect decision? and what is a correct decision? Thus, finally, from the reflections and responses that are generated, it is concluded in a kind of freedom, the freedom to make mistakes.
